Advisory Neighborhood Commission 1A regularly reviews applications from the Alcoholic Beverage and Cannabis Administration (ABCA) for alcoholic beverage and cannabis licenses, including various endorsements. During our review process, it sometimes becomes necessary to negotiate an agreement to delineate terms that specify how an alcohol-serving or medical cannabis retail business operates for the public interest.

A settlement agreement, as defined by ABCA, is a contract between an alcoholic beverage or medical cannabis licensed establishment and other parties that includes terms and conditions intended to address neighborhood concerns.

Once an agreement is negotiated, usually by the Single-Member District Commissioner where the establishment seeking a license is located, it is voted on by the full commission. If adopted, it is transmitted to the Alcoholic Beverage and Cannabis Board (ABC Board) for their review and approval, which allows it to be incorporated against a business’s license. Once it is approved and incorporated against a license, a voluntary or settlement agreement remains with the license as long as the license is effective, including during renewals or a transfer of the license to another establishment.
